This Privacy Policy provides the Arte Fiamma, LLC., a Florida limited liability company, its affiliates, subsidiaries, assigns, and those acting on its behalf (collectively, “Arte Fiamma”), policies and procedures for collecting, using, and disclosing your information in the provision of various services provided by Arte Fiamma (the “Services”). Users may access the Services directly with Arte Fiamma, through its website or affiliated third-party websites (collectively, the “Websites”), applications on various Devices (defined hereinafter), or through other third-party resources. As used in this Privacy Policy, a “Device” means any computer used to access the Services, including without limitation, a desktop, laptop, mobile phone, tablet, or other consumer electronic device and “Information” means all of the different forms of data, content, files, folders, and information described below.
This Privacy Policy governs your access to and use of the Services, regardless of how you access it, and by accessing or using the Websites and the Services, you are agreeing to be bound by and comply with this Privacy Policy. If you are using and/or accessing the Websites or the Services on behalf of an organization, you are agreeing to this Privacy Policy for that organization and warranting that you have the authority to bind that organization to this Privacy Policy. In that case, “you” and “your,” as used in this Privacy Policy, will refer to that organization.
1. The Information Arte Fiamma Collects and Stores:
Arte Fiamma may collect and store the following information when running the Services:
Information You Provide. Depending on the Services which you use, or upon your engagement with Arte Fiamma, Arte Fiamma collects Personal Information (defined hereinafter) such as, without limitation, your name, phone number, credit card, or other billing information, email address, and home and business postal addresses. You may also ask Arte Fiamma to import your contacts by giving Arte Fiamma access to your third-party services (for example and not limitation, your email account) or to use your social networking information if you give Arte Fiamma access to your account on social network connection services. You may also provide Arte Fiamma with your contacts’ email addresses when sharing folders or Files (defined hereinafter) with them. Arte Fiamma may also receive Information (for example and not limitation, your email address) through other users, for example if they have tried to share something with you. Any third-party contact information, including, without limitation, email addresses, provided by you to Arte Fiamma or by your use of the Service are not used by Arte Fiamma for marketing or solicitation, unless the third party provides its consent. In any event, Arte Fiamma will not sell any of your Personal Information or Personal Information of a third party which you provided to any third party.
Files. Arte Fiamma may collect and store files that you upload, download, otherwise provided to Arte Fiamma, or access with the Services (“Files”). If you add a File to your Arte Fiamma account that has been previously uploaded by you or another user, Arte Fiamma may associate all or a portion of the previous file with your account rather than storing a duplicate.
Log Data. When you use the Services on the internet, Arte Fiamma may (directly or through a third-party) automatically record information from your Device, its software, and your activity using the Services. This may include, without limitation, the Device’s Internet Protocol (“IP”) address, browser type, the web page visited before you came to the Websites, information you search for on the Websites, locale preferences, identification numbers associated with your Devices, your mobile carrier, date and time stamps associated with transactions, system configuration information, metadata concerning your Files, and other interactions with the Services. Arte Fiamma also may use and collect information, statistics and analytics with respect to the third parties with which you interact using the Services.
Cookies. When you use the Services on the internet (directly or through a third-party), Arte Fiamma may use “cookies” to collect information and improve the Services. A cookie is a small data file that Arte Fiamma transfers to your Device. Arte Fiamma (directly or through a third-party) may use (by way of example and not limitation) “persistent cookies” to save your registration ID and login password for future logins to the Services. Arte Fiamma may use (directly or through a third-party) (by way of example and not limitation) “session ID cookies” to enable certain features of the Services, to better understand how you interact with the Services and to monitor aggregate usage and web traffic routing on the Services. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all aspects of the Services and they may not function to their best capabilities.
2. How Arte Fiamma Uses Personal Information:
Personal Information. In the course of using the Services (directly or through a third-party), Arte Fiamma may collect personal information that can be used to contact or identify you (“Personal Information”). Personal Information is or may be used (by way of example and not limitation): (i) to provide and improve the Services, (ii) to administer your use of the Services, (iii) to better understand your needs and interests, (iv) to personalize and improve your experience, and (v) to provide or offer software updates and product announcements. If you no longer wish to receive communications from Arte Fiamma, please follow the “unsubscribe” instructions provided in any of those communications, or update your account settings information.
Geo-Location Information. Some Devices allow applications to access real-time location-based information (for example and not limitation, GPS). Arte Fiamma does not currently have a mobile application, but it reserves the right to do so in the future and may facilitate access to the Services through third-party applications, and in any of such events such a mobile application may collect such information from your mobile Devices at any time while you download or use such mobile applications. Some Information you provide to Arte Fiamma may contain recorded location information. Arte Fiamma may use this Information to optimize your experience. If you do not wish to share Files embedded with your geo-location information with Arte Fiamma, please do not upload them. If you do not want to store location data in your Information, please make sure to remove such Information. Also, some of the Information Arte Fiamma collects from a Device, for example and not limitation, IP addresses, can sometimes be used to approximate a Device’s location.
Analytics. Arte Fiamma also collects some Information itself or uses third party services using logging and cookies, such as (by way of example and not limitation) IP addresses, which can sometimes be correlated with Personal Information. Arte Fiamma uses this information for the above purposes and to provide some of the Services, monitor and analyze use of the Services, for the Services’ technical administration, to increase the Services’ functionality and user-friendliness, and to verify users have the authorization needed for the Services to process their requests.
3. Information Sharing and Disclosure:
Your Use. If you establish an account or profile with Arte Fiamma, it has the right to display your Personal Information in your profile page and elsewhere on the Websites and the Services according to the preferences you set in your account. Any Information you choose to provide should reflect how much you want others to know about you. Please consider carefully what Information you disclose in your profile page and your desired level of anonymity. Arte Fiamma does not sell your Personal Information to third parties, though it may use your Information with third parties in the provision of the Services, and you consent to same. Through certain features of the Services, you may also have the ability to make some of your Information public. Public Information may be broadly and quickly disseminated.
Service Providers, Business Partners and Others. Arte Fiamma may use certain trusted third party companies and individuals to help it provide, analyze, and improve the Services (including but not limited to data storage, maintenance services, database management, web analytics, payment processing, design applications, and improvement of the Services’ features). These third parties may have access to your Information only for purposes of performing these tasks on Arte Fiamma’s behalf and under obligations similar to those in this Privacy Policy.
Compliance with Laws and Law Enforcement Requests; Protection of Arte Fiamma's Rights. Arte Fiamma may disclose to third parties Files stored with Arte Fiamma and Information about you that Arte Fiamma collects when Arte Fiamma has a good faith belief that disclosure is reasonably necessary to (a) comply with a law, regulation, or compulsory legal request; (b) protect the safety of any person from death or serious bodily injury; (c) prevent fraud or abuse of Arte Fiamma, its shareholders, officers, employees, or clients; or (d) to protect Arte Fiamma’s property rights. If Arte Fiamma provides your Information or Files to a law enforcement agency as set forth above, Arte Fiamma may attempt to remove any encryption from the Files before providing them to such law enforcement agency. However, Arte Fiamma may not be able to decrypt any Files that you encrypted on your own.
Business Transfers. If Arte Fiamma is involved in a merger, acquisition, or sale of all or a portion of its assets, your Information may be transferred as part of that transaction, and Arte Fiamma may not notify you of any change in control or use of your Personal Information or Files, or if either become subject to a different privacy policy.
Non-private or Non-Personal Information. Arte Fiamma may disclose your non-private, aggregated, or otherwise non-personal information.
4. Changing or Deleting Your Information:
If you are a registered user of the Websites (if such service is available), you may review, update, correct or delete the Personal Information provided in your registration or account profile by changing your account settings. If your Personal Information changes, or if you no longer desire to use the Services, you may update or delete it by making the change on your account settings. In some cases Arte Fiamma may retain copies of your Information if required by law.
5. Data Retention:
Arte Fiamma will retain your Information for as long as your account is active or as needed to provide you the Services. If you wish to cancel your account or request that Arte Fiamma no longer use your Information to provide you the Services, you may have the option to delete your account. Arte Fiamma may retain and use your Information as necessary to comply with Arte Fiamma’s legal obligations, resolve disputes, and enforce Arte Fiamma’s agreements. Consistent with and subject to these requirements, Arte Fiamma will try to delete your Information quickly upon request. Please note, however, that there might be latency in deleting information from Arte Fiamma’s servers and backed-up versions might exist after deletion. In addition, Arte Fiamma does not delete from its servers Files that you have in common with other users. Arte Fiamma follows generally accepted standards to protect the Information submitted to Arte Fiamma, however, no method of electronic transmission or storage is 100% secure, and therefore Arte Fiamma does not guarantee and disclaims its absolute security.
6. Arte Fiamma Social Media and Third-Party Websites:
The Services may include matters which relate to publicly accessible social media services such as blogs, forums, Facebook, and Twitter. You should be aware that any Information you provide in these areas may be read, collected, and used by others who access them. Your posts may remain even after you cancel your account. The Websites may include links to third party websites whose privacy practices may differ from those of Arte Fiamma. If you submit Personal Information to any of those third-party sites, your information is governed by their privacy statements. Arte Fiamma encourages you to carefully read the privacy statement of any third-party website you visit.
You grant Arte Fiamma a non-exclusive and non-revocable license to reproduce your Information to the extent that it is not Personal Information (in the event that you are an individual and not an entity) in any form or manner (including, but not limited to, advertising or promotions, video, internet posting, reproduction, display, email, publication, packaging, sales, and distribution), through the Websites, social media, and services provided by third parties, throughout the world in any medium now known or later developed and without restriction or limitation, and in such event, you agree that such license is not contingent upon credit being given to you.
7. Arte Fiamma’s Policy Toward Children:
Arte Fiamma’s Services are not directed to persons under 13 years of age unless expressly stated otherwise. Arte Fiamma is in compliance with the requirements of COPPA (Children’s Online Privacy Protection Act) and does not knowingly collect personally identifiable information from anyone under 13 years of age. The Websites and the Services are all directed to people who are at least 13 years of age or older. If a parent or guardian becomes aware that his or her child has provided Arte Fiamma with personal Information without their consent, he or she should contact Arte Fiamma immediately. If Arte Fiamma becomes aware that a child under 13 has provided it with personal Information, Arte Fiamma will take reasonable steps to delete such Information.
8. Your Acceptance of this Privacy Policy:
This is Arte Fiamma’s entire Privacy Policy and it supersedes any earlier version. You agree to it every time you use the Websites and/or the Services. This Privacy Policy may change from time to time. If Arte Fiamma makes a change to this Privacy Policy that it believes materially reduces your rights, it will provide you with notice (for example, and not limitation, by email or by posting a notice on the Websites). Arte Fiamma may provide notice of changes in other circumstances as well. By continuing use of the Services after those changes become effective, you agree to be bound by the revised Privacy Policy, regardless of whether such notice has been served, reviewed, or not. Arte Fiamma encourages you to periodically review this page for the latest information on Arte Fiamma’s privacy practices. Your only remedy, if you do not accept the terms of this Privacy Policy, is to discontinue use of the Websites and the Services.
